Terms of Use

Last updated: 12 March 2026 · Effective date: 12 March 2026

1. Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Aerosim (HK) Ltd and its research division Aerotyrnd (“we”, “us”, “our”) governing your access to and use of the Universal Aviation Aptitude Test (“UAAT”) platform, including all associated services, content, and functionality.

By creating an account or using the platform, you agree to be bound by these Terms. If you are using the platform on behalf of an organisation (flight school, university, airline, or authority), you represent that you have the authority to bind that organisation to these Terms.

These Terms are governed by the laws of Hong Kong SAR. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by applicable consumer protection laws in your jurisdiction that cannot be excluded, restricted, or modified by agreement.

2. Platform Description

UAAT is a standardised, multi-dimensional aviation aptitude assessment platform comprising six modules: Cognitive, Psychological, Knowledge, Communication, Operational, and Behavioral. The platform uses artificial intelligence to deliver, evaluate, and score assessments aligned with ICAO standards and regional aviation authority requirements.

The platform is designed as a supplementary assessment tool for aviation training and selection purposes. UAAT results do not constitute a licence, rating, endorsement, or certification issued by any aviation authority.

3. Account Registration and Security

To access assessment features, you must create an account and provide accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorised use of your account
  • Ensuring that the information associated with your account remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that contain false information, are used in breach of these Terms, or are inactive for an extended period (with prior notice).

4. Assessment Tokens and Payments

Certain assessment modules require tokens to access. Tokens may be purchased directly or allocated by your organisation. The following terms apply:

  • Token prices are displayed in the applicable currency at the time of purchase and include any applicable taxes
  • Tokens are non-transferable between accounts unless allocated by an organisation administrator
  • Refunds for unused tokens may be requested within 14 days of purchase, subject to our refund policy and applicable consumer protection laws
  • Tokens consumed during an assessment (including assessments that are abandoned or disconnected mid-session) are non-refundable, except where the platform experienced a verified technical failure

5. Acceptable Use

You agree to use the platform only for its intended purpose of aviation aptitude assessment and training. You must not:

  • Attempt to gain unauthorised access to the platform, other users’ accounts, or our systems
  • Use automated tools, bots, or scripts to interact with the platform or extract content
  • Share, reproduce, or distribute assessment questions, scenarios, or scoring criteria
  • Impersonate another person or misrepresent your identity during assessments
  • Use external aids, reference materials, or third-party assistance during timed assessments unless expressly permitted
  • Interfere with or disrupt the platform’s operation or other users’ experience
  • Use the platform for any unlawful purpose or in violation of any applicable law or regulation

Breach of these acceptable use provisions may result in immediate suspension or termination of your account, invalidation of assessment results, and notification to your affiliated organisation.

6. Assessment Integrity

The integrity of UAAT assessments is fundamental to their value. All assessment content, including questions, scenarios, scoring rubrics, and AI evaluation criteria, is confidential and proprietary. You acknowledge that:

  • Assessment results reflect your individual performance and are intended for use by authorised parties (you, your organisation, and relevant aviation authorities)
  • We may use AI-based monitoring to detect irregularities in assessment sessions
  • We reserve the right to invalidate results where assessment integrity has been compromised
  • Sharing assessment content with third parties may constitute a breach of these Terms and applicable intellectual property laws

7. Intellectual Property

All intellectual property in the UAAT platform, including but not limited to software, assessment content, scoring algorithms, AI models, trade marks, logos, and design elements, is owned by or licensed to Aerosim (HK) Ltd. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the platform in accordance with these Terms.

You retain ownership of any personal content you submit (such as your name and profile information). By using the platform, you grant us a limited licence to use your assessment responses for the purposes of scoring, generating feedback, and improving the platform (using de-identified and aggregated data).

8. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law:

  • The platform is provided “as is” and “as available” without warranties of any kind beyond those implied by law
  • We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses or other harmful components
  • UAAT assessment results are indicative and supplementary; they do not replace formal aviation authority examinations, medical assessments, or licensing requirements
  • AI-generated feedback and scoring, while aligned with ICAO standards, may contain inaccuracies and should be considered alongside professional instructor guidance

Our liability for any loss or damage (however caused, including by negligence) arising from or in connection with these Terms or the platform is limited, to the extent permitted by law, to the amount you paid for tokens in the 12 months preceding the event giving rise to the claim, or USD $100, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the platform if you breach these Terms, subject to providing reasonable notice where practicable.

Upon termination, your right to use the platform ceases immediately. We will retain your personal information in accordance with our Privacy Policy and any applicable legal obligations. Assessment records may be retained for verification purposes as described in our Privacy Policy.

10. Dispute Resolution

If a dispute arises in connection with these Terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation in Hong Kong SAR.

Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction. These Terms are governed by the laws of Hong Kong SAR, and the parties submit to the non-exclusive jurisdiction of the courts of Hong Kong SAR.

11. General Provisions

Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the platform.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Amendments: We may amend these Terms at any time by posting the revised Terms on the platform. Material changes will be notified to you via email or platform notification. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
